I e-mailed Mandy at ODH yesterday for clarification on the guidance document recommendation, and I received the following response (I added the emphasis):

QUOTE
You are required to inspect schools twice per year, as the law previously required before Jarod's Law.  Before Jarod's Law, each health department decided what it was they were going to inspect for and/or used the guidance provided by ODH.  ODH is recommending that you continue to use the school inspection manual that was Jarod's Law.  However, you are not required to use the guidance.  Your local health department can decide for itself what it wants to inspect.  If you decide to continue to use the ODH guidance, we have been recommending that you split the inspection items into two inspections (i.e., all indoor environments on one inspection and the rest of the guideline on the other inspection).  As before, there will be no stronger enforcement than what your department is willing to do to get schools to comply with your recommendations.  They will no longer be required by law to provide a plan of abatement with a schedule for remediation.  Some local health departments are talking about adopting some or all of Jarod's Law as local rules.  If your department is interested in this approach, you should talk with you county prosecutor.

Thanks for posting this repsonse Jason. This definetly clears up the issue of using the most recent guidelines, at least for me.

Our dept. is using HDIS for school inspections, does anyone know if the old carbon paper school inspection forms will be used. I'm guessing the new school insepction forms cannot be used since they reference code.

ORC 3707.03

This section authorizes the BOH to abate a public health nuisance and to remove or correct a condition detrimental to health or well-being found upon school property. The BOH meay serve an order upon the BOE, school board, or other person responsible for such property for the abatement of a public health nuisance or condition within a reasonable, but fixed time.

From 1953 but is still on the books and it's what we used to have residential playground equipment removed from a playground a decade ago. This section basically allows the BOH to order the school system to comply with the ODH guidence if they so choose.

We've come up with an inspection form for our school inspections. It's a pretty basic template on Excel. We added a few CYA (or in this case COA) clauses at the beginning. It should be attached (hopefully).

Have you read this from the Head of ODH?


Sounds like the we will be waiting on new guidance coming from ODH in December of this year.

Jarod's Law and guidelines are GONE. Hi Ho HI HO, Back to the old days we go.
